Loyalty Programme Terms and Conditions

Terms and Conditions valid from 02.06.2026

I. General provisions

1. The loyalty programme is operated under the name Yoer Loyalty Programme in the Yoer.pl online store.

2. The Organiser of the Programme is Yoer sp. z o.o., entered in the register of entrepreneurs of the National Court Register under KRS number: 0000977297, NIP: 6981861413, REGON: 522443153, with its registered office and address for service: ul. Jana Henryka Dąbrowskiego 267, 60-406 Poznań, e-mail address: sklep@yoer.pl , tel. 656 141 696, hereinafter referred to as the “Organiser”.

3. The Organiser is the party promising the reward within the meaning of Art. 919 of the Civil Code.

4. These Terms and Conditions define the rules, scope, conditions of organisation and participation in the Yoer Loyalty Programme.

5. The Terms and Conditions are the only document defining the rules, scope, conditions of organisation and participation in the Programme.

6. The Terms and Conditions are available in the Store.

7. In matters not regulated by these Terms and Conditions, the following provisions shall apply:

a) the Terms and Conditions of the Yoer.pl Store,

b) the Act on the provision of electronic services of 18 July 2002,

c) the Consumer Rights Act of 30 May 2014,

d) the Civil Code Act of 23 April 1964,

e) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR),

f) and other applicable provisions of Polish law.

 

II. Definitions

1) Business Day - one day from Monday to Friday, excluding public holidays.

2) Registration Form - a form available in the Store that enables the creation of an Account.

3) Account - the Customer’s individual panel in the Store, created after registration, where the Customer’s data, order information and information about awarded and used Points are stored.

4) Customer - a person using the Store.

5) Consumer - a natural person performing a legal transaction with the Organiser that is not directly related to their business or professional activity.

6) Individual Entrepreneur - a natural person concluding an agreement directly related to their business activity, if it follows from the content of that agreement that it is not of a professional nature for that person.

7) Programme - the Yoer Loyalty Programme operated by the Organiser under the rules set out in these Terms and Conditions.

8) Points - settlement units awarded to Participants under the Programme for actions specified in these Terms and Conditions.

9) Reward - a benefit due to the Participant in exchange for collected Points.

10) Points Discount - a discount granted to the Participant in exchange for using a specified number of Points.

11) Terms and Conditions - these Terms and Conditions of the Yoer Loyalty Programme.

12) Store Terms and Conditions - the Terms and Conditions of the Yoer.pl Store available in the Store.

13) Store - the online store operated by the Organiser at Yoer.pl.

14) Goods - a product available in the Store.

15) Participant - a natural person holding an Account in the Store. Every natural person who creates an Account in the Store automatically becomes a Participant in the Programme.

16) Product Rating - a text statement concerning Goods purchased in the Store.

17) Product Review - a text statement concerning Goods purchased in the Store.

18) Photo for a Review - a photo added by the Participant to a Product Review.

19) Order Rating - a rating concerning the course of order fulfilment.

20) Order Review- a text statement concerning order fulfilment or the shopping experience.

 

III. Participation in the Programme

1. Every natural person who registers an Account in the Store automatically becomes a Participant in the Programme.

2. Participation in the Programme is free of charge and linked to having an active Account in the Store.

3. Creating an Account in the Store means participation in the Programme under the rules set out in these Terms and Conditions.

4. The Participant is not obliged to use the Points or Rewards available in the Programme.

5. The Participant may use Points and Rewards only after logging in to their Account.

6. Points are assigned to the Participant’s Account and may not be transferred to other persons or other Accounts.

7. The Participant is obliged to use the Programme in accordance with the Terms and Conditions, the Store Terms and Conditions, the provisions of law and good practices.

8. The Organiser may refuse to award Points or cancel Points awarded to the Participant if a breach of the Terms and Conditions, abuse of the Programme or action to the detriment of the Organiser is found.

 

IV. Personal data

1. The controller of the Participants’ personal data is the Organiser.

2. The Participants’ personal data are processed for the purpose of maintaining the Account, servicing the Programme, calculating Points, making Rewards available and handling complaints related to the Programme.

3. The Participants’ personal data are processed in accordance with applicable law and in accordance with the Privacy Policy available in the Store.

4. The Participant has the rights specified in the personal data protection regulations.

 

V. Points in the Programme

1. The Participant is awarded Points for:

a. purchases in the Store – 1 Point for each full PLN 1 of the order value, excluding delivery costs;

b. adding a Product Rating – 5 Points;,

c. adding a Product Review – 25 Points;

d. adding a Photo to a Product Review – 50 Points;

e. adding an Order Rating – 5 Points;

f. adding an Order Review – 5 Points.

2. Points are credited to the Participant’s Account 14 days after the order has been paid for.

3. Points for purchases are calculated on the value of the Goods covered by the order, after deducting delivery costs.

4. Points for reviews, ratings and photos are awarded only for content that complies with the Store Terms and Conditions, these Terms and Conditions and the provisions of law.

5. Points for a review or rating are awarded regardless of whether the review or rating is positive, neutral or negative.

6. The Organiser has the right to refuse to award Points for content that:

a. violates the provisions of law,

b. contains vulgar language,

c. contains advertising content,

d. infringes the personal rights of third parties,

e. is not related to the rated Goods or order,

f. is added artificially or automatically.

7. The Organiser may limit the possibility of awarding Points for repeatedly adding the same or similar content.

8. Points may be awarded and used only by a Participant logged in to their Account.

9. Points may not be exchanged for a cash equivalent.

10. Points do not expire, subject to the situations specified in the Terms and Conditions.

11. Points are not a means of payment or electronic money.

 

VI. Rewards and use of Points

1. The Participant may use the collected Points under the rules set out in these Terms and Conditions.

2. Two types of Rewards are available in the Programme:

a. the possibility to purchase a selected product for a specified number of Points - in such a case, the Participant bears only the delivery cost;

b. the possibility to use a Points Discount when shopping in the Store.

3. The Organiser may specify the number of Points required to purchase a given product.

4. The availability of products that can be purchased for Points may be limited.

5. In the case of purchasing a product for Points, the Participant uses a specified number of Points assigned to that product and bears only the delivery cost.

6. In the case of purchasing a product for Points, the Participant does not pay the price for the product in money.

7. In the cart, the Participant may select one of the following Points Discounts:

a. PLN 50 discount for 1000 Points;

b. PLN 100 discount for 2000 Points;

c. PLN 150 discount for 3000 Points.

8. The Participant may use only one Points Discount for one order.

9. The Points Discount applies only to the value of the Goods in the cart.

10. The Points Discount does not apply to delivery costs and does not reduce transport costs.

11. Transport costs are not covered by the Points Discount.

12. Points Discounts:

a. PLN 50 for 1000 Points,

b. PLN 100 for 2000 Points,

c. PLN 150 for 3000 Points

cannot be combined with other discount codes, code promotions or the -10% discount for persons subscribed to the newsletter.

 

VII. Returns and Points

1. If the Participant returns a product for the purchase of which they received Points, those Points will be deducted from their Account.

2. If the Participant makes a partial return of an order, the Organiser will deduct the Points awarded for the returned Goods.

3. If the Participant returns a product that was purchased exclusively for Points, the Points used to purchase that product will be returned to their Account.,

4. If the Participant returns a product for the purchase of which they used a Points Discount, the Points used for the discount will be returned to their Account.

5. In the event of cancellation of an order or failure of the sales agreement to be concluded, the Points used for such order will be returned to the Participant’s Account.

6. Returns of Goods are carried out under the rules set out in the Store Terms and Conditions.

7. The Consumer and the Individual Entrepreneur may withdraw from the agreement within 100 days from the date of receipt of the Goods.

8. The Goods must be returned no later than within 14 days from the date of withdrawal from the agreement.

 

VIII. Complaints concerning Goods and orders

1. Complaints concerning Goods or order fulfilment are considered in accordance with the Store Terms and Conditions.

2. The Organiser will respond to the complaint within 14 days from the date it is submitted.

 

IX. Account and participation in the Programme

1. Participation in the Programme is linked to having an Account in the Store.

2. The Participant may not resign solely from participation in the Programme while keeping the Account.

3. The Participant may choose not to use Points or Rewards available in the Programme.

4. Deleting the Account means ending participation in the Programme.

5. If the Account is deleted, unused Points are forfeited.

6. The Organiser may cancel Points collected in breach of the Terms and Conditions.

 

X. Amendments to the Terms and Conditions

1. The Organiser reserves the right to amend the Terms and Conditions for important reasons, in particular in the event of:

a. changes in the provisions of law;

b. changes to the functionality of the Store or Account;

c. changes to the rules of operation of the Programme;

d. introduction of additional functions, Rewards, discounts or possibilities to use Points;

e. the need to ensure the safe functioning of the Programme;

f. the need to prevent abuse;

g. the need to remove ambiguities or simplify the rules of the Programme;

h. significant organisational, technical or business needs of the Organiser.

2. An amendment to the Terms and Conditions does not affect the rights acquired by Participants before the amendment enters into force.

3. Information about an amendment to the Terms and Conditions will be made available in the Store or provided to Participants electronically.

4. The amended Terms and Conditions apply from the date indicated in the information about the amendment, but not earlier than from the date they are made available to Participants, unless the amendment is beneficial to the Participants or results from mandatory provisions of law.

 

XI. Termination of the Programme

1. The Organiser may terminate the Programme for important reasons.

3. Information about the termination of the Programme will be made available in the Store.

5. The Organiser will specify the deadline by which Participants will be able to use the collected Points.

After the indicated deadline, unused Points are forfeited.

 

XII. Final provisions

1. The Terms and Conditions are available in the Store.

2. Advertising and promotional materials concerning the Programme are for information purposes only.

3. In the event of discrepancies between advertising materials and the Terms and Conditions, the Terms and Conditions shall prevail.

4. Any disputes will be resolved in accordance with the provisions of Polish law.

5. The Terms and Conditions enter into force on 02.06.2026.
