Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), I hereby inform you that:

1. The controller of your data is Yoer sp. z o.o. with its registered office in Poznań (60-406), ul. Jana Henryka Dąbrowskiego 267, KRS: 0000977297, Tax Identification Number: 698-186-14-13, sklep@yoer.pl.
2. The Controller processes the following data: first name and surname, residential address, telephone number, e-mail address, Allegro account login, Tax Identification Number (in the case of companies).
3. Your data is processed on the basis of:

   a) Article 6(1)(b) GDPR – to the extent that processing is necessary for the fulfilment of orders and the agreement, and for maintaining the user account;

   b) Article 6(1)(c) GDPR – to the extent that processing results from the Controller’s legal obligations, including keeping financial documentation and archives;

• c) Article 6(1)(f) GDPR – to the extent that processing is necessary for the purposes of legitimate interests pursued by the Controller or by a third party.

4. The personal data provided will be processed for a period of 6 years, i.e. until the limitation period for any potential claims expires, including claims related to the statutory warranty period, due to the need for the Controller to defend itself, or until consent is withdrawn if processing is based on consent.
5. The recipients of personal data are entities to which the Controller is obliged to transfer data under applicable law and entities providing services to the Controller – processing is entrusted on the basis of data processing agreements.
6. Personal data is not transferred outside the European Economic Area.
7. Providing personal data is voluntary, but required for the performance of the agreement and the provision of services by the Controller.
8. No automated decision-making is carried out on the basis of the data provided. The data is used for profiling in order to provide a tailored offer, including granting discounts and rebates.
9. In accordance with the GDPR, you have the right to:
   1. access your data,
   2. rectify your data,
   3. erase your data (to be forgotten),
   4. restrict processing,
   5. data portability,
   6. object, including objecting to the profiling referred to in point 8 above.
10. Regardless of the above, you have the right to lodge a complaint with the President of the Personal Data Protection Office if you find that your data is processed in violation of the GDPR. A complaint may be submitted in writing to the address: ul. Stawki 2, 00-193 Warsaw, Poland, or electronically at the following address.

I. General provisions

1. The controller of your personal data is Yoer sp. z o.o. with its registered office in Poznań (60-406), ul. Jana Henryka Dąbrowskiego 267, KRS: 0000977297, Tax Identification Number: 698-186-14-13, e-mail address: sklep@yoer.pl, hereinafter referred to as the “Controller”.
2. This Privacy Policy, hereinafter referred to as the “Policy”, sets out the rules for processing and protecting Users’ personal data by the Controller in relation to cookies. The Personal Data Processing Rules also apply to data processed using cookies.
3. The Controller makes every effort to protect Users’ personal data against disclosure to unauthorised persons, collection by an unauthorised person, processing in violation of applicable law, and alteration, loss, damage or destruction, as well as to respect the privacy of each User.

II. Personal data security

1. Users’ personal data is processed in compliance with generally applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to personal data processing and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
2. The Controller guarantees the highest level of security for the processed personal data and declares that it has appropriate technical and organisational measures to prevent personal data security incidents and ensure Users’ privacy.

III. Scope of data processing

1. In connection with the User’s use of the Controller’s website, the Controller processes the following types of personal data:
   1. Technical information such as: IP address, browser type and version (e.g. Internet Explorer, Mozilla Firefox, Safari), time zone settings, browser plug-in, operating system used (e.g. Windows 10, Vista, Windows XP, MacOS), device type, hardware model, MAC address, unique identifiers and information concerning mobile networks;
   2. Online access data such as: information concerning the visited website, including URL address, website visit path (including date and time), information about the User’s network, such as device data, nodes, configurations, connection speed and network application performance; visited or searched pages, response times, download errors, length of visits and interaction information, such as scrolling, clicks, mouse movements, and information on whether links were opened by the User.

The data referred to in point a above is processed to enable the User to use the Controller’s website and for the purpose of:

1. 3. adjusting the website content to the User’s individual preferences; primarily, these files recognise the User’s device in order to display the website according to their preferences;
   4. preparing statistics that help understand Users’ preferences and behaviour; the analysis of these statistics is anonymous and enables the content and appearance of the website to be adapted to current trends. Statistics are also used to assess the popularity of the website, enable logging into the service, and maintain the User’s attention on each subsequent page of the service.

2. Personal data potentially collected using cookies is processed on the basis of your consent expressed directly or via your browser settings, i.e. on the basis of Article 6(1)(a) of the General Data Protection Regulation, in connection with Article 173(2) of the Telecommunications Law.
3. Using the Controller’s website does not require logging in, creating an account or providing your data.
4. In order to monitor the website, the Controller may use analytical software belonging to third parties, e.g. Google Analytics. Google Analytics can be deactivated using a browser extension available at: https://tools.google.com/dlpage/gaoptout.
5. In order to make it easier for the User to obtain additional information, the Controller’s website may contain links to websites administered by entities independent of the Controller. These websites may have separate clauses and privacy protection policies.
6. With regard to any websites linked on the Controller’s website that are not owned or controlled by the Controller, the Controller is not responsible for their content, Users’ use of those websites, or the confidentiality rules applicable to them.
7. Personal data will be stored until consent is withdrawn.
8. Data may be transferred to IT service providers, website support providers and advertisers on the basis of an agreement concluded with the Controller, respecting the provisions of the Policy and the Personal Data Processing Rules.

IV. Cookies

1. A cookie is a small file consisting of a string of letters and numbers placed in the web browser, on the hard drive of the User’s computer or mobile device when visiting the Controller’s website.
2. Cookies perform various functions, including remembering User preferences, helping websites and applications work faster and more easily, helping tailor content and advertisements to your expectations and interests, and collecting anonymous, aggregated statistics that help improve the functionality and content of websites and applications. Cookies are an important element that significantly improves the comfort of using the Controller’s website. Cookies are not usually used to store personal data, but they may be used to store User preferences and other information.
3. In many cases, software used for browsing websites, i.e. a web browser, allows cookies to be stored on the user’s end device by default. The browser can be set to refuse cookies or notify you when they are sent. To prevent and delete cookies, follow the instructions available in the browser’s help function. Detailed information on the possibility and methods of handling cookies is available in the software settings, i.e. web browser settings.
4. Acceptance of cookies is not required to use the Controller’s website; however, some website functions or services may not work properly without cookies, so we recommend accepting them in order to use the Controller’s website fully and have proper access to all its functionalities.
5. Cookies may also be used by entities cooperating with the Controller, involved in optimising the website and adapting its content.

V. User rights

1. In connection with the processing of personal data by the Controller, the User has the following rights:
   1. the right to access personal data provided to the Controller and obtain a copy of it,
   2. the right to request rectification of personal data when it is outdated, incomplete or incorrect,
   3. the right to request deletion of personal data from the Controller’s datasets, the so-called right to be forgotten,
   4. the right to request restriction of personal data processing,
   5. the right to lodge a complaint with the President of the Personal Data Protection Office if the User considers that the processing of personal data violates generally applicable law,
   6. the right to request personal data portability.
2. In certain circumstances provided for by law, the User also has the right to object to the processing of data concerning them.

VI. Final provisions

1. This Policy applies from 01.07.2022.
2. The Controller reserves the right to amend this Policy at any time. Any changes will be published immediately on the Controller’s website.

   1. Article 6(1)(b) GDPR – to the extent that processing is necessary for the performance of services provided via the mobile application;
   2. Article 6(1)(f) GDPR – within the scope of the Controller’s legitimate interest, which is maintaining the IT system and for statistical purposes.

1. General provisions

This Privacy Policy defines the method of collecting, processing and storing personal data necessary for the provision of services via the YOER mobile application, hereinafter referred to as the “Application”, by Yoer sp. z o.o.

The User acknowledges that the controller of personal data is Yoer sp. z o.o., formerly Yoer Adrian Kazer, with its registered office at ul. Jana Henryka Dąbrowskiego 267, 60-406 Poznań, registered under Tax Identification Number: 698-186-14-13 and entered in the KRS under number: 0000977297.

A User is any natural person using services provided via the Application.

The User’s personal data is processed by the Controller for the purpose of registration in the application and for the purpose of the User’s use of services provided within the mobile application.

The User hereby accepts the rules contained in the Privacy Policy.

2. Personal data

The User acknowledges that providing personal data is voluntary, but necessary in order to fully use the YOER mobile application. The User provides personal data to the Controller after accepting the Privacy Policy during registration in the application.

Personal data collected when creating a YOER account may include information such as: first name, surname, e-mail address, mobile phone number, nickname, profile photo.

Information about the user’s device will be collected, such as: device model, operating system, unique device identifier, IP address, YOER software version number, access type and model, etc.

This data may be needed for the User to contact the Controller and to use certain functions of the Application.

This data will be used exclusively to enable correct, complete and efficient communication between the Controller and the User and to perform certain functions of the Application.

3. Non-personal data

The Controller collects statistical data that is not identified with a specific User. Below are some of the collected non-personal data and how it is used:

• the User’s language preferences, postal code, area code and time zone, which are completed by the User after downloading the application;
• after consent to participate in our Customer Service Quality Improvement Program, we may collect statistical data concerning the use of product functions.

In the event of improper closing or a crash, the Controller collects information concerning the User’s mobile device in order to diagnose the problem.

• geographical data collected when the User uses services or functions based on location information, e.g. location search, use of advertisements, use of weather functions, information available based on maps, etc.;
• cookies and other technical files collected to improve service quality, e.g. saving preferred language settings, sending e-mails in a readable format, determining whether e-mails have been opened, etc.
• IP address, browser type, language, referral source, operating system, date and time, and click-through rate data. During the first use and activation of the YOER device, the application may obtain the device’s unique identification code and approximate geographical information.

4. Rights and obligations of the Controller

The Controller undertakes to process the User’s personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to personal data processing and on the free movement of such data, and repealing Directive 95/46/EC, i.e. the General Data Protection Regulation, the Act of 10 May 2018 on the Protection of Personal Data, hereinafter referred to as the Act, and other applicable personal data protection laws.

The Controller undertakes to maintain the security and confidentiality of personal data obtained from data subjects, to provide appropriate technical and organisational measures ensuring the security of processed personal data, in particular preventing access to it by unauthorised third parties or processing in violation of generally applicable law, and preventing loss, damage or destruction of personal data.

The User’s personal data will be stored for as long as necessary for the Controller to provide services via the Application.

The Controller has the right to disclose the User’s personal data to: subsidiaries; third parties in the event of selling all or part of its shares to them, or in the event of the Controller’s merger with a third party, or acquisition of shares in the Controller’s company by a third party; other third-party entities that have accepted the Privacy Policy, provided that the Controller has concluded with them an agreement necessary for the Controller to provide services via the Application; competent authorities that request disclosure of personal data on the basis of appropriate grounds under generally applicable law.

Personal data will be disclosed by YOER sp. z o.o. only for the purpose of providing and improving products or services and will not be disclosed for marketing purposes.

5. Rights and obligations of the User

The User has the right to access their personal data via the Application.

The User may at any time modify, change, supplement or delete the personal data provided, using the tools available in the Application.

If the User deletes personal data, the User will lose the ability to use Application functions that use this data.

The Controller reserves the right to amend the Privacy Policy, of which the User will be informed via the Application. If the User does not consent to the introduced changes, the User is obliged to permanently delete the Application from their mobile device.

In order to use the application, the User undertakes to confirm that they have read and understood the entire content of this Privacy Policy.

6. Final provisions

The Controller declares that it will make every effort to ensure Users a high level of security when using the YOER mobile application; however, it has no influence on guaranteeing full transmission security over the Internet. All events affecting the security of information transmission should be reported to the e-mail address serwis@yoer.pl.

In matters not regulated by this Privacy Policy, the relevant provisions of generally applicable law shall apply accordingly. In the event of inconsistency between the provisions of this Privacy Policy and the above provisions, those provisions shall prevail.

The User acknowledges that the Controller, in accordance with applicable law, is entitled to change its name, registered office or legal form of business, together with the resulting changes to numbers assigned by the relevant registers. For the avoidance of doubt, the above changes do not constitute an amendment to this Privacy Policy.
